Most people learn about investment strategies from various sources eg, Banks, Newspapers (printing adverts from banks / financial institutions), Financial Advisors, friends etc.  However, there is a HUGE secret that very few people know about, but one in which the very wealthy have been investing in.  What’s the secret?

What’s a Tax Lien Certificate you ask?

In the UK, like it or not, we have to pay council tax.  This is a local authority tax placed on people to enable the county to supply community services eg police, ambulance, fire, schools etc.  Now the equivalent of council tax in the US is property tax.

In the UK, if we fail to pay our council tax then the local authority starts legal proceedings to get the money from you.  They will place a CCJ (County Court Judgement) against you, thus blackening your credit score; they will take you to court and either the court will issue a warrant for a bailiff to go in and seize property to the value of the judgement and legal costs to enable the local authority to recover their money; or the judge may even send you to prison if they believe you do not have goods to cover the judgement.  All of this is very time consuming and costly for the local authorities and they still may not recover their monies.

The US has a far more sensible way of obtaining money for their property taxes.  When a homeowner in the US fails to pay their property tax, the county places a legal charge against the property called a TAX LIEN.  This prevents the homeowner from selling the property and refinancing the property until the taxes are paid.  Great, but they still don’t have their money.  Now this is the clever bit, they sell these TAX LIENS to investors.  Now your next question would be.

And that strategy is PRE-FORECLOSURES.

In the UK, we refer to foreclosures as repossessions.  So, how do we buy repossessed properties in the UK?  From the auctions you say.  Quite right, that’s the most common method of purchasing repossessed properties, but there are quite a few downs to buying these properties:

Ø      You often get into a bidding war with other investors and invariably the price you pay is far higher than the true market value

Ø      You have to have the cash immediately

Ø      You buy the property “as is” - there is no way for you to survey the property and know if there are any inherent faults

Ø      But the biggest downside to buying repossessed properties is

The HOMEOWNER LOSES THEIR HOME, often getting NOTHING out of the repossession

Why Purchase A Pre-Foreclosure Property?

When a homeowner is going through foreclosure, for whatever reason, that person is under tremendous stress.  If their home is actually foreclosed on, they lose everything, the roof over their head, their credit rating suffers tremendously, relationships often break down, and everything enters a downward spiral for them.  When we contact distressed homeowners, our task is to help them out the best way we can.  Sometimes all they want is to have some cash to walk away, other times they want to remain in the house and be given the option to buy it back in a couple of years time and just pay rent.  What we do is work with them so they come out with something rather than nothing.  It has to be ethical, fair and above all what the distressed seller wants.

One of the biggest mistakes I’ve seen people make is that when they have a distressed seller calling them, all they see are the dollar signs.  To be truly successful in the pre-foreclosure market you must be really good at helping others out of trouble.
